When a Westchester school gym class set up a "stations" physical fitness class it included jump rope and a balance board. The gym teacher related that the balance board required heighten supervision. The plaintiff fell off the board twice before she injured herself and the gym instructor only learned of the injury from two other students. The court held that the defendant school did not prove that heightened supervision was provided to the balance board and the motion for summary judgment was denied.
